Introduction

Your World Healthcare Ireland (YWHCI) is a business which provides work-finding services to its clients and candidates. We must process personal data (including sensitive personal data) so that it can provide these services – in doing so, we act as a data controller.

You may give your personal details to the us directly, such as on an application or registration form or via our website, or we may collect them from another source such as a jobs board, social media pages, colleague, friend, or relative referrals. We must have a legal basis for processing your personal data. For the purposes of providing you with work-finding services and/or information relating to roles relevant to you, we will only use your personal data in accordance with the terms of this privacy notice. This privacy notice forms part of YWHCI obligations to be open and fair with all individuals whose personal data we process and to provide details around how we process such personal data and what we do with it both during and after your working relationship with us.

YWHCI is committed to safeguarding the privacy of personal data and complying with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR) and any future changes in data protection legislation that YWHCI is required to comply with. We are required under legislation to notify of you of the information contained in this privacy notice. This notice may be updated from time to time, but we will provide you with an updated copy as soon as possible.

We may need to request more specific data from you to help us confirm your identity and ensure your right to access the information. This is another appropriate security measure to ensure that personal information is not disclosed to anyone with no right to receive it.

What kind of personal data do we collect?

Candidate data

To provide the best possible employment opportunities that are tailored to you, we need to process certain information about you. We only ask for details of your personal data that will genuinely help us to help you, such as your name, date of birth, gender, photograph, title, contact details, education details, employment history, referee details, emergency contacts, immigration status, nationality, Personal Public Service Number, bank account details, payroll records, tax related information and a copy of your driver's licence/passport/identity card where appropriate and in accordance with employment and contractual requirements. We may also collect information related to your health, diversity information, your current remuneration, pensions and benefits arrangements or details of any criminal convictions.

We may also collect:

  • Extra information that you choose to tell us
  • Extra information that your referees chooses to tell us about you
  • Extra information that our clients may tell us about you, or that we find from other third party sources such as job sites
  • IP address
  • Telephone call recordings
  • The dates, times and frequency with which you access our services
  • CCTV footage if you attend our premises

Client data

We need to collect and use information about you, or individuals at your organisation, in the course of providing you services. We will collect, store and use the following kind of client data which will help us to fulfil our contract with you. The data collected includes information such as client name, key contact identity data, contact data (address, email address, telephone number), financial data (bank account, card payment details), data pertaining to transactions (payment details and product/ service information), technical data (IP address, login details, browser specifications), profile information (username, password, purchases, interests), usage data (website and service usage details) and marketing/communication preferences.

We do not collect any special categories of personal data about you.

Supplier data

We need contact details of relevant individuals at your organisation so that we can communicate with you. For more information as to how we process supplier data, please refer to contractual clauses.

Third party data

We also collect data that relates to third parties such as emergency contacts and referees.

Depending on the type of personal data in question and the grounds on which we may be processing it, should you decline to provide us with such data, we may not be able to fulfil our contractual requirements or, in extreme cases, may not be able to continue to provide services to you.

How do we collect your personal data?

Candidate data

We collect data directly from candidates and employees via registration forms, email, CVs, and other correspondence, for example, with background check and IDVT providers.

We also collect data from third parties such as job portals, social networking sites and referrals from friends or colleagues.Referee and emergency contact details will be collected from candidates.

We will collect additional personal information in the course of job-related activities throughout the period of you working with us.

Client data

We will collect personal data or special category data when legally obliged to do so.

How do we use your personal data?

Candidate data

We will only use candidate’s personal data when the law allows us to. The main reason for using your personal details is to help you find employment. The more information we have about you, your skills and your career ambitions, the better we can make our service to you. This includes making a decision about your recruitment and employment, ensuring you are eligible to work in Ireland, providing work related benefits to you, your education, training and development requirements. Where appropriate and in accordance with local laws and requirements, we may also use your personal data for things like marketing, profiling and diversity monitoring. Where appropriate, we will seek your consent to undertake some of these activities.

Client data

The main reason for using information about Clients is to ensure that the contractual arrangements between us can properly be implemented. This may involve identifying Candidates who we think will be the right fit for you or your organisation or providing a managed service. We may also use your data to pursue a relationship in order to provide our services.

Supplier data

The main reasons for using your personal data are to ensure that the contractual arrangements Between us can properly be implemented, and to comply with legal requirements.

Third Party data

We use referees’ personal data to help our Candidates to find employment which is suited to them. If we are able to verify their details and qualifications, we can make sure that they are well matched with prospective employers. We may also use referees' personal data to contact them in relation to recruitment activities that may be of interest to them. We use the personal details of a Candidates or Staff member's emergency contacts in the case of an accident or emergency affecting that Candidates or member of staff.

Website users

We use your data to help us improve your experience of using our website, for example by analysing your recent job search criteria to help us to present jobs to you that we think you'll be interested in. If you are also a Candidate or Client of Your World Recruitment Group, we may use data from your use of our websites to enhance other aspects of our communications with, or service to, you.

There may be a need to use your data to comply with a legal obligation, protect your interests or the interests of others, in the public interest or for official purposes although this is rare.

If you fail to provide personal information

If you fail to provide certain information when requested, we may not be able to perform the contract we have entered into with you (such as paying you or providing a benefit), or we may be prevented from complying with our legal obligations (such as to ensure the health and safety of our workers).

Change of purpose

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we ned to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

Automated decision making

Automated decision making takes place when an electronic system uses personal information to make a decision without human intervention. If we make an automated decision on the basis of any particularly sensitive information, we must have either your explicit written consent or it must be justified in the public interest and we must also put in place appropriate measures to safeguard your rights.

You will not be subject to decisions that will have a significant impact on you based solely on an automated decision-making, unless we have a lawful basis for doing so and we have notified you.

How do we use particularly sensitive personal information?

'Special categories' of particularly sensitive personal information, such as information about your health, racial or ethnic origin, sexual orientation or trade union membership require higher levels of protection. We need to have further justification for collecting, storing and using this type of personal information. We have in place safeguards which are required by law to maintain when processing such data. We may process special categories of personal information in the following circumstances:

  1. In limited circumstances with your specific consent
  2. Where we need to carry out our legal obligations or exercise rights in connection with employment
  3. Where it is needed in the public interest, such as for equal opportunities monitoring

Less commonly, we may process this type of information where it is needed in relation to legal claims or where it is needed to protect your interests (or someone else's interests) and you are not capable of giving your consent, or where you have already made the information public.

Situations in which we will use your sensitive personal information

In general, we will not process particularly sensitive personal information about you unless it is necessary for performing or exercising obligations or rights in connection with employment. On rare occasions, there may be other reasons for processing, such as it is in the public interest to do so.

Do we need your consent?

We do not need your consent if we use special categories of your personal information in accordance with our written policy to carry out our legal obligations or exercise specific rights in the field of employment law. In limited circumstances, we may approach you for your written consent to allow us to process certain particularly sensitive data. If we do so, we will provide you with full details of the information that we would need and the reasons we need it, so that you can carefully consider whether you wish to consent. You should be aware that it is not a condition of your contract with us that you agree any request for consent from us

Information about criminal convictions

We may only use information relating to criminal convictions where the law allows us to do so. This will usually be where such processing is necessary to carry out our obligations and provided we do so in line with our privacy notice

Who do we share your personal data with?

Candidate Data

We may share your personal data with various parties in various ways and for various reasons where required either by law or where it is necessary to administer the professional working relationship, we have. Primarily we will share your information with prospective employers to increase your chances of securing the job you want. Unless you specify otherwise, we may also share your information with any of our group companies and associated third parties such as umbrella companies or managed service providers where we feel this will help us to provide you with the best possible service. We require all other parties to respect the security of your data and to treat it in accordance with the law.

Client data

We will share your data primarily to ensure that we provide you with a suitable pool of Candidates or to provide you with a Managed service. We may share your information with any of our group companies and associated third parties such as our service providers to help us meet these aims.

Unless you specify otherwise, we may share your information with any of our group companies and associated third parties such as our service providers and organisations to whom we provide services.

How do we protect your personal data?

We care about the security of your personal information. We have policies and procedures in place to ensure that your data is securely stored and protected from unauthorised access or misuse.

Any other parties that we may share your personal data with are required to take appropriate security measures to protect your personal data in line with our policies. They will only process your data on our instructions and where they have agreed to treat the information appropriately. We do not allow parties to use your personal data for their own purposes. We only allow other parties to process your personal data for a specified purpose and only where necessary.

We have put in place procedures to deal with any suspected data breach and will notify you and any applicable regulator of any suspected breach when we are required to do so.

How long do we keep your personal data for?

We will only retain your data for as long as necessary to fulfil the purpose we collected it for. If we have not had meaningful contact with you (or, where appropriate, the company you are working for or with) for a period of three years, we will delete your personal data from our systems unless we believe in good faith that the law or other regulation requires us to preserve it (for example, because of our obligations to tax authorities or in connection with any anticipated litigation).

In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may use such information without notifying you. Once you are no longer a temporary agency worker with YWHCI, we will retain and securely destroy your personal data in accordance with applicable laws.

How do we store and transfer your data internationally?

Your World Recruitment Group has offices and partners around the world – this is what enables us to offer the level of services that we do. For us to continue operating in this way, we may have to transfer or store your data internationally.

In those circumstances we will ensure that your personal information receives and adequate level of protection and will put in place appropriate measures to ensure that your personal information is treated in a way that is consistent and respects the EU and Irish law on data protection.

Changes to privacy notice

We reserve the right to update this privacy notice at any time, and we will provide you with a new privacy notice when we make any substantial updates. We may also notify you in other ways from time to time about the processing of your personal information.
